  1. Thank you visiting The Chiswick Cinema website ( our “site” for short), brought to you by Trafalgar Entertainment together with its affiliates (“we”, “us” or “our”). These terms of use and sale ( “Terms” for short), together with our privacy policy (“Privacy Policy”), set out the terms that apply to your browsing and use of our site. In these Terms, when we refer to “you” and “your” we mean you, the person using or visiting our site.
  2. These Terms set out the ways in which you may access, use and browse our site. By accessing and using our site, you agree to be bound by these Terms.
  3. We may from time to time vary these Terms. Please check the Terms regularly to ensure that you are aware of any variations or amendments. Your use of our site will be subject to the version of the Terms posted on this site at the time of such use.

ACCESS TO AND USE OF OUR SITE

  1. We do not charge to use our site however, you agree that we can change this at a later date as long as we let you know in plenty of time before we start charging for use of the site.
  2. You agree that we can make any changes to the site that we want to and that we can stop making the site available or limit access to it at any time. We do not have to tell you before we do this.
  3. Anything that you may need to be able to access the site, such as computers, mobile devices or internet access, is your responsibility and we don’t have to provide any of this equipment for you. You are also responsible for ensuring that no person uses your equipment to access the site without your permission. We will be entitled to assume that anyone accessing the site using your equipment has your permission to do so and you will be responsible for any charges, costs or liabilities that may be incurred by any such persons while using your equipment.
  4. You must not attack the site with any viruses or other things that might be harmful to the site or any of our users. Any hackers or other trouble makers may be reported to law enforcement authorities.

If you do decide to visit any other site, you do so at your own risk but should be aware that other third-party sites may have their own terms and conditions, which we suggest you read carefully before proceeding.

You must not frame our site on another or establish a link in such a way as to suggest that we might be associated with another third party or site where we’re not.

OUR LIABILITY

  1. We are responsible to you for the foreseeable loss and damage caused by us as a result of failing to comply with these terms or failing to use reasonable care and skill. By foreseeable loss we mean a loss that is obvious will happen or we both knew it might happen. 
  2. In these Terms we do not exclude or limit our liability to you where it would be unlawful to do so. This includes death or personal injury arising from our negligence; fraud or fraudulent misrepresentation. 
  3. Subject to what we have said in point 2 (above), where it is permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the site, site availability and any content on our site and will not be liable to you for any loss or damage (whether direct or indirect), including any caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your internet-enabled device, software, data or other proprietary material, even if foreseeable, arising under or in connection with your: 

                     3.1 use of, or inability to use, the site;

                     3.2 use of or reliance on any content displayed on our site; or

                     3.3 downloading of any content on our site, on any website linked to our site.

Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, loss or loss of business opportunity.

GENERAL

  1. No one else has any rights under this contract against either us or you. This contract is between you and us. The Contracts (Rights of Third Parties) Act 1999 does not apply to these Terms.
  2. You can’t transfer your agreement with us to anyone else without our permission.
  3. We may transfer this agreement to another organisation, but we will let you know if we plan to do this and will ensure that the transfer will not affect your rights under the contract. 
  4. If we decide not to exercise or enforce any right that we have against you at a particular time, then this does not prevent us from later deciding to exercise or enforce that right. 
  5. If a court or regulator finds any part of these Terms illegal, invalid or otherwise unenforceable, then, where required, that part shall be deleted from the Terms and the remaining parts of the Terms will continue to be enforceable. 
  6. These Terms set out the full extent of our obligations and liabilities concerning the site and services provided through it and replace any previous agreements and understandings between us and you. 
  7. You agree that you will not have any remedy in respect of any untrue statement (whether made innocently or negligently) made to you upon which you relied in agreeing to these Terms other than any remedy you may have for breach of the express terms of these Terms. 
  8. These Terms and any non-contractual obligations arising out of them shall be governed by and construed in accordance with English law. To the extent that the law of the country in which you are resident permits you agree to submit to the non-exclusive jurisdiction of the English courts.

MEMBERSHIP TERMS AND CONDITIONS 

Please read and retain a copy of the below terms and conditions (the “T&Cs”) carefully, as by registering to The Chiswick Cinema Membership Scheme (as detailed in Section 6 below), these apply to you. The Chiswick Cinema reserves the right to add or amend these T&Cs from time to time, at its discretion. Changes will take effect as soon as they are posted on The Chiswick Cinema Website or The Chiswick Cinema Social Media except for price rises applicable to The Chiswick Cinema Membership Scheme. 

  1. To become a member, you must be 18 or over except for Under 25 Members.
  2. To become a member, you must pay a membership fee (the “Membership Fee”). The Membership Fee is the fixed amount in force at the time of joining the chosen Chiswick Cinema Membership and is payable prior to issuance of a membership card (the “Membership Card” (physical or virtual)) by means of debit or credit card.
  3. To become a member, you agree to apply by providing your personal details to The Chiswick Cinema by filling in a form (e.g. online application) subject to the Private Policy.
  4. Your application to become a Member is an offer to join one of The Chiswick Cinema Memberships that will be accepted by taking payment of the Membership Fee, which will create a contract between you and The Chiswick Cinema (the “Membership Agreement”). The Chiswick Cinema reserves the right to decline your offer.
  5. Membership Cards: As a member you will be issued with a Membership Card (physical or virtual). Your Membership Card: 

       5.1 is usable upon collection in venue or receipt of your Membership identification number (the “Membership ID”). 

       5.2 is to be presented at each of your visits to The Chiswick Cinema or your Membership ID is to be inserted on The Chiswick Cinema Website to redeem your benefits online. The Chiswick Cinema is entitled to request proof of your age, identity and/or residence to confirm compliance with these T&Cs or to conform to law, regulation, court order or similar public authority; 

       5.3 is to be used at The Chiswick Cinema only. There may be participating cinemas in the future, and these will be available to view on The Chiswick Cinema website, subject to changes from time to time at The Chiswick Cinema’s discretion. Please visit The Chiswick Cinema website or ask in The Chiswick Cinema for up-to-date details. 

       5.4 is giving you the right to enjoy the advantages on a personal and non-transferable basis and always in accordance with these T&Cs. This also includes access being subject to availability, age restriction, private hires of The Chiswick Cinema, Admission Terms of Use and/or any relevant promotion terms applicable from time to time. 

       5.5 is to be used on its own and cannot be used in conjunction with any promotions offered by The Chiswick Cinema unless otherwise indicated.

       5.6 is personal and cannot be assigned or transferred or exchanged or sold to anyone else; and, is to be used on its own and cannot be used in conjunction with any promotions offered by The Chiswick Cinema unless otherwise indicated. 

       5.7 is and remains The Chiswick Cinema’s property at all time that it is in your possession for your own personal and non-commercial use only (please keep your Membership Card safe at all times). 

6. The benefits of the Founder Membership can be found in your online sign in area and will be updated accordingly.  

7. The benefits of the Gold Membership can be found in your online sign in area and will be updated accordingly.  

8. The benefits of the Classic Membership can be found in your online sign in area and will be updated accordingly.  

9. The benefits of the U25 Membership can be found in your online sign in area and will be updated accordingly.  

10.The Chiswick Cinema reserves the right to ask for proof of membership status at any time while you are on the premises. 

11. We will not give refunds for any uncollected or unused Membership Tickets or Complimentary Guest Tickets. Tickets bookings not collected by the scheduled start time may be cancelled if there is high demand for the screening. 

11.1 Membership Tickets, Complimentary Guest Tickets and Discounts can only be used for the duration of the Membership. For the avoidance of doubt: 

11.2 If the Membership is terminated, you will not be able to book tickets for any films or claim any Discounts after the termination date.

11.3 If the Membership is suspended, you will not be able to book any tickets or claim any Discounts until the Membership suspension is lifted. 

12. Lost, stolen or damaged physical Membership Cards: You must keep your Chiswick Cinema Membership Card secure and in your possession at all times. Any lost or stolen Membership Card should immediately be reported to The Chiswick Cinema at [email protected]. Your lost or stolen Membership Card will be deactivated. If you subsequently find or retrieve such deactivated lost or stolen Membership Card, please destroy it immediately. 

12.1 You must treat your Membership Card with care, and not damage it, or misuse it. If your Membership Card is damaged or defective, please contact The Chiswick Cinema to request a replacement card. 

13. Withdrawals – The Chiswick Cinema reserves the right to withdraw your membership in in The Chiswick Cinema’s reasonable opinion you:  

13.1 Have used your membership/membership card fraudulently, abusively or unlawfully;

13.2 Have caused material behavioural issues

13.3 Have failed to comply with your obligation to keep your security information secure

13.4 Have seriously breached these T&C’s

13.5 Have been banned on reasonable grounds from entering The Chiswick Cinema.

13.6 The withdrawal of your Membership for the above reasons means that you will not be able to use it thereafter and it will not give rise to any form of compensation or refund to you.

14. Intellectual Property Rights: All copyright, trademarks and all other intellectual property rights in and in relation to the Chiswick Cinema’s Membership Scheme and/or Membership Card shall at all times remain the property of The Chiswick Cinema or its underlying rights holders.

15. Partner Benefits: Partner benefits can be revoked at any time and must be used in accordance with the partner’s terms and conditions.

16. Data Protection and security: The Chiswick Cinema will process your personal data in order to open, administer and run your account and deal with any enquiry you may have about it. The Chiswick Cinema plays the role of the data controller. If you choose or are provided with, a username, user identification code, password, security question & answer, verification number or any other piece of security information as part of our security procedures, you must treat such information as confidential and not disclose it to anyone. If you become aware of any unauthorised use of your security information you must inform The Chiswick Cinema immediately. 

17. Cancellation, termination, discontinuation:

17.1 The Chiswick Cinema reserves the right to discontinue the Membership Scheme and to stop issuing Membership Cards

17.2 The Chiswick Cinema may alter the Membership Advantages from time to time by posting the notice on The Chiswick Cinema Website. 

17.3  You may cancel any Membership purchased remotely (by telephone or email) within the first 14 days after issuance; The Chiswick Cinema will refund the Membership Fee paid to you or the person who paid the same. After such 14-day period, you may terminate your Membership and The Chiswick Cinema will make no refund unless your situation presents some exceptional circumstances that would justify refunding at The Chiswick Cinema’s sole discretion. For any cancellation however caused, The Chiswick Cinema is entitled to charge you at the standard rate for any instances where you have benefited from any advantages by using your cancelled Membership or Card. If your usage equates the Membership Fee, no refund will occur. If your usage exceeds your Membership Fee, you will be charged at the standard rate. 

17.4 Payment for Membership will be under a Continuous Payment Authority when you sign up to the Recurring/Pay Annually Membership option as opposed to the One-Off. This is in order to ensure that your Membership is able to continue without interruption.  Recurring payments will be collected on the anniversary of the first payment date against the card you registered with. If insufficient funds are available, we will attempt to retake the payment three times until successful.  If the payment still fails, the Membership will expire until a new payment method is provided. 

        17.5 You can cancel the Continuous Payment Authority at any time after the first payment so that it won’t recur in subsequent years. You can do so by contacting          [email protected].  

18. Liability:

       18.1 Except where expressly provided, nothing in these T&Cs shall constitute a warranty or representation regarding any aspect of The Chiswick Cinema’s products or  services where a Membership Card is defective, The Chiswick Cinema’s liability is limited to the replacement of such defective Card. Where erroneous pricing information has been given to you, and the error is obvious and could reasonably have been recognised by you as erroneous, we will not be obliged to supply goods and services at the erroneous price. The Chiswick Cinema shall not be liable to you for any special, indirect or consequential losses incurred by you in any way. Neither shall The Chiswick Cinema be liable or responsible for any failure to perform, or delay in performing any of its obligations under these T&Cs that are caused by events outside The Chiswick Cinema’s reasonable control.

18.2 The Chiswick Cinema’s total liability for all claims shall not exceed the amount of the Membership Fee. 

18.3 Nothing shall be construed as to exclude or limit The Chiswick Cinema’s liability for death or personal injury caused by The Chiswick Cinema’s negligence, for fraud or fraudulent misrepresentation committed by The Chiswick Cinema or its agents, or for any other liability which may not be excluded or limited by law. ing shall be construed as to exclude or limit The Chiswick Cinema’s liability for death or personal injury caused by The Chiswick Cinema’s negligence, for fraud or fraudulent misrepresentation committed by The Chiswick Cinema or its agents, or for any other liability which may not be excluded or limited by law.

19. Assignment by The Chiswick Cinema: The Chiswick Cinema reserves the right to assign any and all of its rights or obligations under the Membership Agreement to any company part or affiliated to The Chiswick Cinema’s group.

GIFT CARDS, E-GIFT CARDS AND GIFT MEMBERSHIPS 

  1. The Gift Card or e-Gift Card is valid for use in Chiswick Cinema only. The value on the Gift Card or e-Gift Card can be used towards payment for the purchase of cinema tickets, food and beverages, merchandise or a Chiswick Cinema Membership. To use your Gift Card or e-Gift Card your Gift Card or e-Gift Card must have enough funds to cover the whole transaction. To use your Gift Card or e-Gift Card in person at the cinema, Gift Cards or e-Gift Cards may be used as part payment towards the total cost of the transaction.
  2. Defaced, illegible or photocopied Gift Cards will not be accepted.
  3. The Gift Card or e-Gift Card does not entitle you to any credit or other form of financial accommodation.
  4. We shall not be liable to you or the User in the event of loss, theft, unauthorised use or re-sale of any Gift Card or e-Gift Card.
  5. Your Gift Membership activation card can be activated online by inputting the voucher number displayed in the confirmation email. The activation email cannot be used as a part payment on another type of membership and there will be no leftover balance after the membership activation has been completed.
  6. You may only submit one Gift Membership voucher per activation.
  7. Gift Membership vouchers are valid for 12 months from date of issue and are non-transferrable and non-refundable. Unused credit cannot be extended after expiration date.
  8. Cancellation rights: You may cancel your purchase of the Gift Card or e-Gift Card and claim a refund at any time up to fourteen (14) calendar days from (and including) the day on which you receive our email confirming acceptance of your order (the “Cancellation Period”). If the Gift Card or e-Gift Card has been used before your cancellation has been processed, you will only receive a refund of the balance remaining on the Gift Card or e-Gift Card at that time. Once the Cancellation Period has expired, you will not be able to cancel your purchase of the Gift Card, e-Gift Card or claim any refund in that respect. 

COMPETITIONS

At times we may choose to run certain competitions either internally or with partners. 

  1. Employees of The Chiswick Cinema or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition.
  1. All entrants must be over the age of 18 years and this competition is only eligible to UK Residents.
  2. Competition prizes are subject to availability. Travel, accommodation, and other expenses are not included. 
  3. Once the prize is confirmed, The Chiswick Cinema will contact the winner to arrange delivery of the prize.
  4. No responsibility can be accepted for entries not received for whatever reason.
  5. After the closing date we will not accept entries to the competition. The winner will be chosen by The Chiswick Cinema at random from all valid entries. The winner will be contacted within 7 days of the closing date to claim their prize. If the winner cannot be contacted or does not claim the prize within 7 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
  6. The Chiswick Cinema reserves the right to cancel or amend the competition and these terms and conditions without notice at any time but especially in the event of a catastrophe, war, civil or military disturbance, act of God, venues closing as a result of Government guidance in regards to Covid-19 or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
  7. The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
  8. No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability, and we reserve the right to substitute any prize with another of equivalent value without giving notice.
  9. The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
  10. By entering this competition, an entrant is indicating their agreement to be bound by these terms and conditions. By entering this competition, you are not giving The Chiswick Cinema permission to use your information for future marketing for The Chiswick Cinema. The Chiswick Cinema will not disclose this information to third parties for marketing purposes.
  11. The competition and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.

Terms of Admission

1. DEFINITIONS

1.1 ‘You’ means everyone who purchases a ticket and everyone who visits The Chiswick Cinema, whether or not they have purchased a ticket. 

1.2 ‘Us’ or ‘We’ means The Chiswick Cinema generally.

2. age restrictions

Entry to films and events is restricted by the classification given by the British Board of Film Classification or others. We are required to refuse admission to anyone who is below the minimum age required by the relevant classification. 

2.1 Anyone can be admitted to films classified as U or PG.

2.2 Children under 12 can be admitted to films classified as 12A but only if accompanied by an adult (i.e. someone over the age of 18).

2.3 Nobody under the age of 15 can be admitted to films classified as 15.

2.4 Nobody under the age of 18 can be admitted to films classified as 18.

2.5 Children under the age of 12 must be accompanied by someone who is at least 18 years of age to be admitted after 7.00pm. Children under the age of 8 must be accompanied by someone who is at least 18 years of age at all times (regardless of film classification).

2.6 Babies under the age of one year can go into screenings providing that:

2.7 they sit on a lap for the entire screening (i.e. do not take up a seat); and

2.8 they are removed from the auditorium should they cause disturbance to other customers; and

2.9 the film is classified as U, PG or 12A.

2.10 Babies (under one years old)  will be admitted without charge. Anyone else requires a ticket.

2.11 We reserve the right to require you to prove your age with appropriate photographic ID if you are going to a 12A, 15 or 18 film or if purchasing an alcoholic drink. If you are unable to prove your age you will not be able to watch the film or buy an alcoholic drink. We reserve the right to ask for such proof at any time you are on our premises.

2.12 If you buy a ticket before we know its classification and you are not old enough to be admitted to the screening we will issue you with a full refund.

3. food and drink

3.1 No hot food or alcohol from outside the premises is permitted in the cinema building. 

3.2 You must observe the licensing regulations at the cinema concerning the sale and consumption of alcoholic drinks.

3.3 You must not smoke inside any of our premises. E-cigarettes cannot be used anywhere in The Chiswick Cinema, the same as normal cigarettes.

3.4 You must take steps to inform your server of any allergen requirements.

4. general

4.1 Mobile phones must be switched off or in silent mode before you enter the auditorium. You must not use phones inside the auditorium during the screening. 

4.2 To avoid disturbing customers who arrive on time, customers arriving after the film has started may be refused admission to the performance. Refunds will not be issued by us in these circumstances.

4.3 You must adhere to any health and safety procedures or instructions that are in place and notified to you by our staff or by notices.

4.4 It is a serious criminal offence to copy or attempt to copy any film or other copyright material exhibited in any part of the cinema, punishable on conviction with an unlimited fine and imprisonment of up to a maximum of ten years. You are not permitted to bring cameras and/or recording equipment of any kind into the cinema.

4.5 As a courtesy to your fellow audience members, and to prevent film theft, we ask that customers do not enter any cinema auditorium using any ‘wearable technology’ capable of recording images. Any customer found wearing such technology will be asked to remove it and may be asked to leave the cinema.

4.6 We endeavour to show films in accordance with the programme that we advertise. However, there may be circumstances in which we are unable to comply with the advertised programme and in such cases, our liability to you is limited to a full refund of the tickets purchased. We are unable to take responsibility for programme information advertised by third parties.

4.7 Full refunds will be given (minus any booking fees paid) up to 24 hours before the showtime. Tickets will not be refunded if less than 24 hours notice is given.

4.8 Full refunds for premium-priced events (minus any booking feeds paid) will not be given unless 24 hours notice is given.

4.9 We do not accept requests for refunds by email. Applications for refunds should be made in person at the box office only.

4.10 We reserve the right to ask for proof of status for concessionary tickets at any time that you are on our premises.

4.11 You must not purchase tickets except for personal use and you represent and warrant that tickets are not purchased as part of any form of a for-profit business or commercial activity unless we have expressly authorised otherwise in writing.

4.12 ‘Midweek Movies’ – prices are kept at matinee prices all day and evening for all films (excluding special events). Further discounts not applicable. Members’ free tickets can be redeemed. We retain the right to revert to standard pricing. 

4.13 ‘Parent&Baby’ – Our Parent & Baby shows are solely for a maximum of two adults plus a baby (up to 18 months). No other admittance is given.

4.14 ‘Kids Club’ – Our Kids Club screenings are solely for children accompanied by a maximum of two adults per child (up to 15 years). No other admittance is given.

4.15 We accept no responsibility for any personal property that is brought to a cinema. 

4.16 You must comply with the conditions on our Licences as notified to you by our staff or by notices.

5. refusal of admission

5.1 We reserve the right to refuse admission or require you to leave the premises without a refund if you:

5.2 behave in an anti-social or threatening manner; or

5.3 put the safety of our customers, our employees or our property at risk; or

5.4 bring a camera or recording equipment of any kind into the cinema; or

5.5. otherwise, breach these Terms.
